N.J. Man Sues Over Alleged Mosh Pit Injuries
PITTSBURGH, PA (CelebrityAccess MediaWire) — A New Jersey man has filed a lawsuit over injuries that he allegedly sustained after being pulled into a mosh pit at a punk rock show in Pittsburgh.
According to the Pittsburgh Tribune-Review, 24-year-old Joseph Pignatiello has filed a suit against the venue, Mr. Small's Fun House; the venue's owner Liz Berlin; the band Senses Fail; and the concerts' production company Opus One. In the suit, Pignatiello alleges that the defendants “failed to prevent aggressive, intoxicated, drugged and/or otherwise impaired individuals from forming a mosh pit" and that they “permitted and/or encouraged the formation of the mosh pit” despite knowing the band's pits tended to be aggressive.
Pignatiello claims that he broke a knee and sprained a shoulder after other concert-goers pulled him into the pit.
A message machine at the club was full and the owners couldn't be reached for comment.
